Boxing Waiver and Release
Assumption of risk, release of liability, and consent.
WARNING — PLEASE READ CAREFULLY.
BY ELECTRONICALLY SIGNING THIS DOCUMENT, YOU GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. THIS IS A SEPARATE DOCUMENT FROM THE MEMBERSHIP TERMS.
1. Activities Covered
This Waiver applies to the participant's presence at OneTwoSlipTwo Boxing and voluntary participation in boxing, fitness and related activities, including warm-ups, strength and conditioning, running, skipping, bags, pads, partner drills, contact drills, sparring when specifically authorized, open-gym use, private training, classes, events and use of equipment or facilities (the “Activities”).
2. Specific Risks
The participant understands that the Activities are strenuous and may involve deliberate or accidental bodily contact. Risks may arise from the participant, coaches, other participants, spectators, equipment, flooring, premises, training methods, weather, travel or causes that are known, unknown, foreseeable or unforeseeable, including:
- Slips, trips, falls, collisions, overexertion and equipment malfunction or misuse.
- Bruising, cuts, strains, sprains, dislocations, fractures and injury to teeth, eyes, face, neck, spine or internal organs.
- Concussion, repeated head impacts, traumatic brain injury, neurological impairment and cumulative or delayed symptoms.
- Heat illness, asthma or allergic reaction, infection, cardiac event, paralysis, permanent disability or death.
- Negligent acts or omissions of the Released Parties or others, to the extent such liability may lawfully be released.
The participant understands that protective equipment, rules, supervision and coaching reduce but do not eliminate risk, and that no level of boxing or fitness activity is completely safe.
3. Voluntary Assumption of Risk
The participant freely chooses to take part, understands the nature and physical demands of the Activities, accepts all inherent and ordinary risks described in this Waiver, and assumes responsibility for injury, loss or damage arising from those risks.
4. Release and Agreement Not to Sue
IMPORTANT RELEASE. TO THE FULLEST EXTENT PERMITTED BY LAW, THE ADULT SIGNER RELEASES AND AGREES NOT TO SUE THE RELEASED PARTIES FOR CLAIMS, DEMANDS, DAMAGES, LOSSES, COSTS OR CAUSES OF ACTION ARISING FROM THE ACTIVITIES OR USE OF THE PREMISES, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.
“Released Parties” means 1001688026 Ontario Inc., OneTwoSlipTwo Boxing, and their present and future directors, officers, employees, contractors, coaches, volunteers, agents, affiliates, landlords, property owners and occupiers, and their respective successors and assigns.
This release is not intended to apply to gross negligence, reckless or wilful misconduct, deliberate harm, or any liability, statutory right or consumer remedy that cannot legally be excluded or waived. It must be interpreted only to the extent permitted by applicable law.
5. Indemnity
The adult signer agrees to indemnify and hold the Released Parties harmless from third-party claims, losses or reasonable costs caused by the signer's intentional misconduct or negligent violation of safety rules. This indemnity does not require the signer to indemnify a Released Party for that Released Party's own gross negligence, reckless or wilful misconduct, or liability that cannot lawfully be excluded.
6. Personal Property
The participant accepts responsibility for personal property brought to the facility. To the fullest extent permitted by law, the adult signer releases claims for loss, theft or damage except where caused by conduct that cannot lawfully be released.
7. Health, Conduct and Emergency Care
- The participant confirms they are physically and medically able to participate, will disclose relevant restrictions, and will obtain medical advice or clearance when appropriate.
- The participant will follow coach instructions, posted rules, progression requirements and equipment directions; will use required protective gear; and will report hazards or injuries promptly.
- The participant will not train while impaired or while experiencing symptoms that make participation unsafe, including suspected concussion symptoms, chest pain, severe shortness of breath, faintness or acute illness.
- Contact drills, sparring and competition require separate coach approval and may require additional medical, sport-governing-body or event documentation. Approval may be withdrawn at any time for safety.
- The participant authorizes reasonable first aid, emergency assistance and contact with emergency services when staff reasonably consider it necessary. The participant is responsible for personal medical and ambulance costs unless applicable law provides otherwise.
8. Minor Participant and Guardian Terms
If the participant is under 18, the parent or legal guardian confirms authority to give consent, has reviewed the Activities and risks with the minor in an age-appropriate way, consents to the minor's participation, and will ensure the minor follows safety rules and coach instructions.
Minors. Nothing in this document is intended to waive or release a minor's legal rights where a parent or guardian cannot legally do so. The guardian signs the guardian's own acknowledgements, consents, release (for the guardian's own claims) and indemnity for the guardian's own conduct, to the fullest extent permitted by law. Online sign-up is for adults 18 and over; a minor's membership and guardian waiver are completed in person at the gym.
9. General
This Waiver is governed by Ontario law and applicable federal Canadian law. If a provision is unenforceable, it will be narrowed or severed only as necessary and the remaining provisions continue. This Waiver does not replace the membership agreement, privacy policy, safety rules or any separate sparring or competition consent.
The signer confirms there was an opportunity to read the full Waiver, ask questions and seek independent advice, and that no oral statement changed its meaning.
